General Terms and Conditions of Business

1. General

1.1 CTS Eventim Schweiz AG ("Eventim") operates a ticket distribution organisation under the name of "Eventim", which includes the Eventim website and Eventim call centre.

1.2 These General Terms and Conditions of Business form the basis for using the Eventim website and for making use of Eventim services, in particular purchasing tickets via the Eventim ticketing system. By clicking on the check box: "I have read and accepted the General Terms and Conditions of Business", customers declare that they acknowledge and shall adhere to the General Terms and Conditions of Business.


2. Eventim System

2.1 Eventim and its suppliers endeavour to provide customers, where possible, with trouble-free and professional services in accordance with the latest technological standards. To that end Eventim uses tried and tested techniques and experienced specialists and suppliers (jointly referred to as: "Suppliers") by way of adopting the necessary care. Nevertheless, Eventim cannot guarantee fault-free rendering of the Eventim services without interruptions or rule out unlawful intervention in the EDP system or inappropriate use by unauthorised persons, and rejects any liability for damage that may be caused as a result. Liability for third-party services is excluded to the extent that is permissible by law.

2.2 Customers shall use their hardware (including printers), operating software and telecommunications facilities at their own risk and cost to use the Eventim services. Customers acknowledge that Eventim and its suppliers/licensors are not under obligation to support or maintain certain software, or to support certain operating platforms or systems or maintain their support in the future. Eventim rejects, as part of the statutory provisions, any liability for damage to the customers’ EDP systems as a result of the use of the Eventim website or the use of Eventim services.

2.3 Customers acknowledge without reservation that all Eventim services called up via their accounts shall be attributed to the customers. Customers shall take precautionary measures that are acceptable in commercial terms to keep the password secret and prevent use by unauthorised parties or misuse. Customers shall inform Eventim (info@eventim.ch) without delay if they have reason to assume that their password could be misused, and shall render Eventim and its suppliers exempt, within their area of responsibility, to an extent that is specified by law from damage that is caused by unauthorised or inappropriate use or manipulation of the Eventim website or Eventim services. In the event of suspicion of unauthorised or inappropriate use, Eventim shall in any case be entitled to stop rendering, or refuse to render, Eventim services.


3. Tickets

3.1 Customers acknowledge that rights and obligations, in particular from ordering tickets and/or making use of other services available on the Eventim website, arise solely between the respective promoter and customers. In respect of any kind of concerns or claims in conjunction with events themselves, apart from in relation to processing the ticket procedure, customers are to approach the respective promoter directly.

3.2 Tickets shall be checked at the entrance to the event. A right is reserved to check the entitlement of the party producing the tickets.

3.3 Tickets must be obtained directly via an official distribution channel to be deemed valid. Copying, altering or imitating tickets is prohibited.
Tickets may not be transferred, and are to be protected against damp, soiling, damage and mechanical and visual effects etc. The bar code must be machine readable.

3.4 Insofar as the ticket is not taken upon entering the event, it is to be kept until the end of the event, and on request is to be presented. Any misuse involving tickets is prohibited. The instructions issued by the event personnel are to be followed. In the case of non-compliance, claims for damages may be asserted in addition to forfeiture of the entitlement to participate.

3.5 Taking back or exchanging tickets is excluded apart from cases in which an event is cancelled in accordance with paragraph 3.7.

3.6 In the case of acquiring a ticket, the buyer shall be responsible for storing the admission ticket. Replacing lost, damaged or stolen tickets is excluded.

3.7 Tickets shall remain valid should an event be postponed. In the case of cancellation of an event without a replacement event, tickets may be returned, if specified by the promoter, within 30 days following announcement of the cancellation. Customers who have purchased their tickets via the Eventim website or the Eventim call centre, and have paid by credit card, shall receive a credit note transferred to the credit card used to pay for the tickets. In all other cases tickets are to be returned to one of the Eventim ticket offices.

3.8 Eventim or an Eventim ticket office shall, in any case, only reimburse the purchase price or issue a credit note to the extent that the promoter's respective regulation enables Eventim or the Eventim ticket agency to reimburse amounts or issue credit notes. The promoter is responsible for reimbursing amounts for ticket prices. Reimbursement or a credit note that extends above the ticket price is excluded in any case.


4. Personal data

4.1 Customers acknowledge and agree that Eventim and its suppliers may gain knowledge of personal data in conjunction with the provision and maintenance of the Eventim website and rendering Eventim services. Eventim shall endeavour to guarantee confidentiality in a manner that is permitted by law and is acceptable in commercial terms.


5. Information

5.1 Eventim shall endeavour to provide information on the Eventim website that is complete, up-to-date and accurate. However, Eventim cannot assume any liability such that the information provided on the Eventim website is accurate, complete and up-to-date or assume liability for transmission errors, and rejects any liability for resulting damage or activities. Customers acknowledge that Eventim cannot, in particular, assume any liability for the content of linked third-party websites, and that it rejects any liability in that respect.


6. Rights to the Eventim website and the Eventim ticketing system

6.1 The Eventim website and Eventim ticketing system are protected by copyright and other rights. All rights in that respect, including ownership and/or utilisation rights, are held by Eventim and/or its suppliers/licensors.


7. Amending the General Terms and Conditions of Business

7.1 Eventim reserves the right to adjust and amend the General Terms and Conditions of Business at any time. Customers shall be informed appropriately of amendments to the General Terms and Conditions of Business, in particular by way of a corresponding publication on the Eventim website. Please therefore visit the Eventim website regularly.


8. Applicable law / place of jurisdiction

8.1 Swiss law is applicable.
At Eventim's discretion the courts with jurisdiction at Eventim's respective registered office shall be responsible for assessing possible disputes in conjunction with using the Eventim website or making use of Eventim services.
